Terms of Service

1. Agreement to Terms

By downloading, installing, or using Wellie ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our application. These Terms constitute a legally binding agreement between you and Wellie.

2. Eligibility

You must be at least 13 years of age to use Wellie. If you are under 18, you represent that you have your parent or guardian's permission to use the App. By using the App, you represent and warrant that you meet these eligibility requirements.

3. Description of Service

Wellie is a pet wellness tracking application that allows you to:

  • Track your pet's wellness across seven dimensions (physical, mental, social, nutritional, activity, environmental, and medical)
  • Log activities, supplements, and nutrition for your pets
  • Sync with Apple HealthKit to import activity data
  • Chat with an AI assistant about your pet's wellness
  • Scan product barcodes for supplement information
  • Receive reminders for supplements, feeding, and activities

4. Account Registration and Security

To use certain features of the App, you must create an account. You may register using:

  • Email and password
  • Sign in with Apple
  • Sign in with Google
  • Magic link (passwordless email authentication)

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

5. User Content

5.1 Your Content

You retain ownership of all content you submit to the App, including pet profiles, photos, activity logs, chat messages, voice recordings, and notes ("User Content"). By submitting User Content, you grant Wellie a non-exclusive, worldwide, royalty-free license to use, store, process, and display your User Content solely for the purpose of providing and improving our services.

5.2 Content Guidelines

You agree not to submit content that:

  • Violates any applicable law or regulation
  • Infringes on intellectual property rights of others
  • Contains malicious code or harmful content
  • Is false, misleading, or fraudulent
  • Harasses, abuses, or harms another person

6. AI Chat Service

Wellie provides an AI-powered chat assistant to help answer questions about pet wellness. You acknowledge and agree that:

  • AI responses are generated by third-party AI services (OpenAI and Anthropic) and may not always be accurate
  • Chat messages are processed by these third-party AI providers to generate responses
  • AI recommendations are for informational purposes only and do not constitute veterinary advice
  • You should always consult a qualified veterinarian for medical decisions about your pet
  • Voice messages may be transcribed using speech recognition technology

7. Apple HealthKit Integration

With your permission, Wellie integrates with Apple HealthKit to:

  • Read workout data, distance, step count, and active energy burned
  • Read workout route data (GPS information)
  • Write activity data back to HealthKit for record keeping

HealthKit data is used solely to provide wellness tracking features and is never sold to third parties or used for advertising. You can revoke HealthKit permissions at any time through your device settings.

8. Third-Party Services

The App integrates with the following third-party services:

  • OpenAI and Anthropic: For AI chat functionality
  • Stack Auth: For authentication services
  • Barcode Lookup API: For product information retrieval
  • Mailjet: For transactional emails

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of these third parties.

9. Device Permissions

To provide full functionality, the App may request the following device permissions:

  • Camera: For scanning barcodes and taking profile photos
  • Photo Library: For selecting profile images and uploading photos
  • Microphone: For recording voice messages in chat
  • Speech Recognition: For transcribing voice messages
  • Notifications: For sending reminders and alerts
  • HealthKit: For activity data synchronization

All permissions are optional, and you may deny any permission, though some features may be unavailable without them.

10. Medical Disclaimer

IMPORTANT: Wellie is not a substitute for professional veterinary advice, diagnosis, or treatment. The App is designed to help you track and organize your pet's wellness information, but it does not provide medical advice.

  • Always seek the advice of a qualified veterinarian with any questions regarding your pet's health
  • Never disregard professional veterinary advice or delay seeking it because of information provided by the App
  • AI-generated responses are for informational purposes only and should not be relied upon for medical decisions
  • In case of a pet emergency, contact your veterinarian or emergency animal hospital immediately

11. Intellectual Property

The Wellie app, including its design, features, functionality, graphics, and source code, is owned by Wellie and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our services without our written consent.

12. Acceptable Use

You agree not to:

  • Use the App for any illegal purpose or in violation of any laws
  • Attempt to gain unauthorized access to any part of the App or its systems
  • Interfere with or disrupt the App's servers or networks
  • Use automated systems, bots, or scripts to access the App
  • Reverse engineer, decompile, or disassemble any part of the App
  • Remove or alter any proprietary notices or labels
  • Use the App to transmit spam, chain letters, or unsolicited communications

13. Termination

We may terminate or suspend your account and access to the App at any time, without prior notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the App will immediately cease. You may also delete your account at any time by contacting us.

14. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WELLIE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the App
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any errors or omissions in any content
  • Any decision made or action taken based on information provided by the App, including AI responses

16. Indemnification

You agree to indemnify and hold harmless Wellie and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the App or violation of these Terms.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

19. App Store Terms

If you downloaded the App from the Apple App Store, you also agree to Apple's Terms of Service. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support services for the App.

20. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
